# Terms of Service for BlinkBot

Welcome to BlinkBot, a product developed by BLINKBOTAI LTD (including all of our affiliates, "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our services, applications, bots, and features—including our automated crypto transaction bot available on X (formerly Twitter) and other social platforms, as well as our website at www.useblink.bot (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
## 1. Binding Arbitration and Class Action Waiver
**WHEN YOU AGREE TO THESE TERMS, YOU ARE AGREEING (WITH LIMITED EXCEPTION) TO RESOLVE ANY DISPUTE BETWEEN YOU AND US THROUGH BINDING ARBITRATION RATHER THAN IN COURT AND TO A CLASS ACTION WAIVER. PLEASE REVIEW CAREFULLY SECTIONS 15 AND 16 BELOW FOR DETAILS REGARDING ARBITRATION AND YOUR RIGHTS. HOWEVER, IF YOU ARE A RESIDENT OF A JURISDICTION WHERE APPLICABLE LAW PROHIBITS ARBITRATION OF DISPUTES, THE AGREEMENT TO ARBITRATE WILL NOT APPLY TO YOU.**

BlinkBot is an AI-powered cryptocurrency transaction platform that operates through automated bots on social media platforms, primarily X (formerly Twitter). We provide an interface that allows users to execute blockchain transactions, including swaps, transfers, and trading of digital assets through simple commands via direct messages or mentions on social platforms. Our Services integrate with various blockchain protocols and decentralized exchanges to facilitate these transactions on your behalf.

## 3. Acceptance of Terms
By using our Services:
- You represent and warrant that you have read, understood, and agree to these Terms as well as any additional policies or guidelines incorporated herein by reference.
- If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
In addition:
- You must be at least 18 years old to use our Services. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
- To access certain features of our Services, you must create an account through X or other supported platforms. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

BlinkBot provides you with an automated interface allowing you to execute cryptocurrency transactions through social media commands. The Services utilize natural language processing to interpret your commands sent via direct messages or mentions to perform blockchain transactions such as swapping tokens, transferring assets, and checking balances.
### 5.1 Non-Custodial Nature of Services
BlinkBot operates as a non-custodial platform. This means:
- **Private Key Security**: We do not have access to, store, or manage your private keys. You maintain full control of your wallet credentials.
- **Account Security**: You are solely responsible for safeguarding your account information and wallet connections.
- **No Asset Custody**: We do not take custody of your digital assets. All assets remain in wallets you control.
- **Direct Blockchain Interaction**: Transactions are executed directly on-chain without us acting as an intermediary.
### 5.2 AI and Automation Disclaimer
The Services utilize artificial intelligence and natural language processing to interpret user commands ("AI Services"). You understand and acknowledge that:
- AI technology is experimental and may occasionally misinterpret commands
- We disclaim all liability for errors in AI interpretation
- You should verify all transaction details before confirmation
- The AI does not provide financial advice or recommendations
### 5.3 Transaction Execution
- **Irreversibility**: All blockchain transactions are final and irreversible once confirmed
- **User Responsibility**: You must carefully verify all transaction parameters before execution
- **Network Fees**: You are responsible for all blockchain network fees (gas fees)
- **Price Volatility**: Digital asset prices may change rapidly during transaction execution
### 5.4 No Professional Advice
All information provided by the Services is for transactional purposes only and should not be construed as financial, investment, tax, or legal advice. You should seek independent professional advice before making financial decisions.
### 5.5 User Control and Transparency
- **Self-Custody**: You retain full ownership and control of your digital assets
- **Transaction History**: All transactions are recorded on public blockchains
- **No Freezing**: We cannot freeze, seize, or restrict access to your assets
## 6. Third-Party Services
Our Services integrate with various third-party platforms and protocols, including but not limited to:
- Decentralized exchanges (DEXs)
- Blockchain networks
- Social media platforms (X/Twitter)
- Price oracles and data providers
Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for any issues arising from third-party service failures or changes.
## 7. Fees and Payment
### 7.1 Transaction Fees
- BlinkBot charges a 0.5% fee on all swap transactions
- Premium features may incur additional fees as specified in the Services
- Network (gas) fees are separate and paid directly to blockchain validators
### 7.2 Payment Processing
Fees are automatically deducted from transactions. You acknowledge and agree to all applicable fees before initiating any transaction.
### 7.3 Taxes
You are solely responsible for determining and paying any taxes applicable to your cryptocurrency transactions.
## 8. User Representations and Warranties
### 8.1 Compliance
You agree to:
- Comply with all applicable laws and regulations
- Not use the Services for illegal activities
- Not engage in market manipulation or fraudulent transactions
- Not attempt to exploit or hack the Services
### 8.2 Accurate Information
You warrant that all information provided to us is accurate and complete.
### 8.3 Bot Commands
You acknowledge that commands sent to our bot are binding and you are responsible for all transactions initiated through your account.
## 9. Prohibited Uses
You may not:
- Use the Services to facilitate money laundering or terrorist financing
- Violate any applicable sanctions or export control laws
- Impersonate others or provide false information
- Interfere with or disrupt the Services
- Attempt to gain unauthorized access to our systems
- Use the Services to manipulate markets or engage in wash trading
## 10. Intellectual Property Rights
### 10.1 Ownership
All intellectual property rights in the BlinkBot name, logo, bot technology, and Services are owned exclusively by BLINKBOTAI LTD.
### 10.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
## 11. Privacy and Data Protection
Your use of our Services is also governed by our Privacy Policy, available at www.useblink.bot/privacy. By using the Services, you consent to our collection and use of data as described in the Privacy Policy.
## 12. Disclaimer of Warranties
**THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.**
You acknowledge that:
- Blockchain technology involves inherent risks
- Digital asset prices are highly volatile
- Technical errors or failures may occur
- We do not guarantee continuous availability of the Services
## 13. Limitation of Liability
**TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA ARISING FROM YOUR USE OF THE SERVICES.**
Our maximum aggregate liability shall not exceed the greater of (a) $100 or (b) the fees you paid us in the 12 months preceding the claim.
## 14. Indemnification
You agree to indemnify and hold harmless BLINKBOTAI LTD, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your cryptocurrency transactions
## 15. Dispute Resolution
### 15.1 Informal Resolution

### 15.2 Mandatory Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration under the American Arbitration Association rules. Arbitration shall be conducted in Delaware, USA.
## 16. Class Action Waiver
**YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.**
## 17. Termination
### 17.1 Termination by You
You may stop using our Services at any time.
### 17.2 Termination by Us
We may suspend or terminate your access for violations of these Terms or at our discretion with or without notice.
## 18. Governing Law
These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.
## 19. Changes to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.
## 20. Export Controls and Sanctions
You represent that you are not:
- Located in a country subject to U.S. sanctions
- On any U.S. government prohibited parties list
- Using the Services in violation of export control laws
## 21. Age Restrictions
The Services are not intended for users under 18 years of age. By using the Services, you represent that you are at least 18 years old.
## 22. Severability
If any provision of these Terms is found invalid, the remaining provisions shall continue in full force.
## 23. Entire Agreement
These Terms constitute the entire agreement between you and BLINKBOTAI LTD regarding the Services and supersede all prior agreements.
